Boohoo awarded injunction in landmark case

Boohoo.com have been awarded an injunction against rival online
fashion retailer Miss Boo in a landmark case, in which Manchester law firm Pannone used Google AdWords results as evidence of potential trade mark infringement.

The owners of boohoo.com, Wasabi Frog Limited, have been trading since 2006 and became concerned when, in September 2009, new company Miss Boo appeared, targeting the same demographic and selling similar fashion items.

Tim Roberts, MD of Manchester SEO firm I-COM, who were handling
Wasabi Frog Limited's AdWords campaign at the time, explains,
"Wasabi Frog Limited were concerned that the similarity in brand name and business plan between the two companies could lead to a loss of revenue on their part"

"It was felt that customers searching for the established domain, boohoo.com, may land on missboo.co.uk and not realise that they were actually looking at a completely different company"

"With this case in mind, I would recommend that brand owners reanalyse their own AdWords statistics to see whether arguments
employed in this case could be used in their own dispute"
