NRF hails US Supreme Court sales tax ruling

The National Retail Federation (NRF) has hailed an apex US court ruling in a case involving South Dakota and e-commerce firm Wayfair, allowing states to require online sellers to collect sales tax at the same rate as local stores. NRF believes a federal legislation must clarify sales tax collection procedure rather than leaving it to states’ interpretation.

The court upheld a 2016 South Dakota law that requires online merchants with more than $100,000 in annual sales or 200 transactions with state residents to collect sales tax.

Termed the decision ‘a major victory’, president and CEO Matthew Shay said in a statement that the ruling clears the way for a fair and level playing field where all retailers compete under the same sales tax rules whether they sell merchandise online, in-store or both.

“Congress must now follow the court’s lead and pass legislation implementing uniform national rules that provide consistency and clarity for retailers across the country,” Shay said.

NRF and other retail groups had argued earlier this year that lack of uniform collection is “inflicting extreme harm and unfairness” on local retailers by “distorting the retail market in favour of absentee e-commerce.” (DS)
