Casual Male Retail Group Inc retail brand operator of Casual Male XL, Rochester Big & Tall, B&T Factory Direct, LivingXL and Jared M, announced that a jury has awarded CMRG $1.5 million against the defendants, Robert Yarbrough, a former business associate, and a competitor, Westport Big & Tall. The case had been pending in Federal court in Massachusetts.
The jury found that Mr. Yarbrough violated his non-competition obligations to Casual Male and misappropriated the Company's trade secrets. The jury also found that Westport Big & Tall engaged in interference with contractual relations.
The jury awarded the Company approximately $1,100,000 in damages against Mr. Yarbrough and a further $400,000 in damages against Westport Big & Tall. Interest will accrue on the awards from 2005.
Casual Male has also sued Cutter & Buck Inc, a competitor and supplier, as well as Mr. Yarbrough, in a separate case for similar violations that is still pending in Massachusetts Federal court.
