“In September 2004 she was fired after being hospitalised for ten days and in spite of having a valid medical certificate.
“In Madagascar, companies are required by law to seek prior authorisation in the dismissal of worker representatives. The Labour Ministry has twice ruled that she should not have been dismissed, and has ordered the company to reinstate her.
“Needless to say, Nisa's dismissal has had the effect of dissuading other workers from seeking election as workers' representatives or forming a union to defend their rights”.
The ITGLWF has asked Jones Apparel to intervene promptly to secure Nisa's reinstatement. The Global Union Federation has also asked Jones Apparel what steps it is taking to ensure that its supplier is in compliance with national laws and international standards.
