Mainland takes administrative measures on textile exports

The Ministry of Commerce (MOC) promulgated the "Administrative Measures on Textile Exports (Interim)" on 18 September 2006, which take effect from the day of promulgation.
The provisional quantitative limits of textile exports in 2006 will continue to be governed by the existing "Provisional Administrative Measures on Textile Exports" (CIC No. 387/2005) promulgated on 22 September 2005.
The Provisional Administrative Measures will be abolished on 1 January 2007.
Compared with the "Provisional Administrative Measures on Textile Exports", the new "Administrative Measures on Textile Exports (Interim)" introduce the following major changes: Article 9 introduces the arrangement of consultative bidding as a means of quota distribution.
It also allows MOC to introduce temporary measures when the quota utilization rate is low or there is disorder in textile export trade;
Article 10 introduces the requirements of fulfilling the country's laws and regulations on labour, safety and environmental protection;
Article 11 introduces a new formula for allocation of quantitative limits based on export performance;
Article 16 allows transfer of quotas through the on-line quantitative limits transfer platform;
Article 18 and 19 advance the deadlines for surrender of unused quotas to MOC and re-distribution of such quotas; and
Article 20 increases the penalties towards enterprises under-utilizing quotas allocated to them.
