Bann Quimica wins patent litigation

Bann and Patrick, however, proved that the patent was invalid based on old patents dating from the early 1900s, including one patent that had been owned by BASF itself.

S.L. Bann, who founded Bann Quimica as a small family business over 50 years ago in Sao Paulo, said that the victory was significant in the dyeing industry and important to his company.

Despite only making one sale of the Bann Quimica indigo solution into the United States before being sued by DyStar, Mr. Bann told the jury that "if you have a suit you have to fight back. You have to defend yourself." Neil Jones, of Nelson Mullins Riley & Scarborough and lead counsel for the accused infringers, explained that "the Federal Circuit could have relied on a number of reasons for invalidating the patent."

"However, the Court chose the one based on the oldest patents and then thoroughly explained why the DyStar invention would have been obvious when DyStar reintroduced its product in 1992." Mr. Bann said that "we are pleased with this decision and the conclusion of this lengthy and expensive litigation."

Bann Química Ltda, founded in 1954, initiated its activities in the area of importation and commercialization of several chemical products for the Brazilian industry.

In 1986, Bann Química Ltda inaugurated the production of Indigo Blue dye at the Paulinia site. Indigo Blue dye is used by the textile industry to make blue denim, the material used for blue jeans. BannQuímica Ltda, today is certified under ISO 9001/2000 by SGS ICS at both its chemical plants and is also certified under ISO 14001/2004 by SGS ICS at its Paulinia plant.
