Australian Wool Innovation Limited (AWI), People for the Ethical Treatment of Animals (PETA) and Animal Liberation (Limited) of New South Wales appeared in the Federal Court today, Friday 17 November 2006.
Justice Rares dismissed the motion from PETA to strike out the claims from the woolgrower co-applicants.
AWI Deputy CEO, Les Targ said the last time AWI and PETA appeared in the Federal Court, Justice Rares expressed his displeasure with PETA's lawyers for making last minute and hurried changes to PETA's application to strike out the woolgrowers' claims.
“Once again they are wasting the Court's time. We have a responsibility to stop PETA and its affiliates from carrying out any further illegal activity intended to destroy the Australian wool industry; and make them pay for the losses they have caused.
“The woolgrower co-applicants have expanded their claim, to include a claim for damage to their reputations caused by misleading and deceptive conduct of PETA and Animal Liberation in breach of the Trade Practices Act.
“Justice Rares said costs relating to PETA's motion that was dismissed, will be considered at the end of the trial.”
Both parties will appear again before the Federal Court on 14 December 2006.
