DuPont's ethylene copolymers business declares 'force majeure'

Science company DuPont declared 'force majeure' for its ethylene copolymers business. The DuPont Packaging & Industrial Polymers manufacturing operations and distribution centers in Orange, Texas, were significantly impacted by Hurricane Rita. While structurally secure, the sites are particularly impacted by the availability of purchased utilities, raw materials and supporting infrastructure.

DuPont is actively assessing the situation and is engaging with local authorities to determine when restart of the facilities can occur. The company is working closely with its customers to lessen the impact on their businesses.

Force majeure clauses are found in business contracts. They excuse the party declaring force majeure from liability if an unforeseen event or circumstance beyond its control prevents it from meeting contractual obligations. Typically these clauses cover natural disasters and other events which are unforeseen and could not be avoided by the exercise of due care.
